NAVIGATION RESTRICTION

(Marine Safety Act 1998 s.12)

Port Botany
Construction Works of New Bulk Liquids Berth

Tuesday 20 September 2011 - Friday 30 November 2012
7:00am to 6:00pm Mondays to Fridays
8:00am to 1:00pm Saturdays

 

THE EVENT

Vessel operators are advised that NSW Maritime has declared that the above construction works, which are to be undertaken within the designated Port Botany Water - Side Restricted Zone between the above times and dates, as a Special Event pursuant to Section 12(2) of the Marine Safety Act 1998.

SPECIAL EVENT & EXCLUSIVE USE AREA

Due to the potential to affect the safety of navigation, NSW Maritime has granted an Exclusive Use Aquatic Licence to John Holland Pty Ltd under Contract to Sydney Ports Corporation to conduct the works, and a Special Event/Exclusive Use Area (‘the Area’) will be established on the navigable waters of the designated Port Botany Water - Side Restricted Zone and extend south from the existing Bulk Liquid Berth 1 (“BLB1”) for approximately 500 metres towards Molineaux Point between 20 September 2011 until 30 November 2012 whilst construction of the berth is undertaken. Construction Work will generally be undertaken from 7am to 6pm Monday to Friday and 8am to 1pm on Saturday. There will be no work on Sunday unless authorised.

The Special Event Area/Construction Zone will be bounded by the below coordinates and the area will be delineated by lit yellow construction buoys at the following locations:

NO VESSELS are permitted to enter the Area / Construction Zone. A NAVIGATION HAZARD will exist in Port Botany between BLB1 and Molineaux Point.

DIRECTIONS

NSW Maritime advises that in relation to the Area:

  1. The Special Event Area / Construction Zone will be closed to all non-authorised vessels.
  2. Persons within the vicinity of the Special Event Area must comply with any directions given by a NSW Maritime Officer or Police Officers in relation to the Special Event or to marine safety. Failure to comply with any such direction is an offence (Marine Safety Act 1998, s.15A - Maximum Penalty $3,300.00).
  3. Persons navigating vessels must not enter the Special Event Area and to do so may constitute an offence (Marine Safety Act 1998, s.12(6) - Maximum Penalty $1,100.00)
  4. Vessel wash must be kept to a minimum. Creation of vessel wash which impacts on the works is an offence (clause 9 Marine Safety (General) Regulation 2009 – Maximum Penalty $5,500.00)

GENERAL

Persons operating vessels in the vicinity of the Area / Construction Zone are reminded of their obligation to maintain vessel speed at no more than 4 knots within 100 metres of floating plant or work in progress; keep well clear of any service craft and equipment and the actual construction area and keep a proper lookout at all times
