Marine Pilotage Legislation
On 1 February 2011 the Government made the Marine Safety (General) Amendment (Pilotage) Regulation 2011. The Regulation amends the Marine Safety (General) Regulation 2009 and provides for the issue, suspension, cancellation, conditions, requirements and other matters in respect of the following types of marine safety licences:
The Regulation has also introduced a NSW Marine Pilotage Code which replaces the previous Training Code for Marine Pilots and Exempt Masters 2003. The NSW Marine Pilotage Code comprises two volumes: NSW Marine Pilotage Code - Volume OneThis volume provides general information and the requirements for qualification, initial training and ongoing training of marine pilots, exempt masters and holders of certificates of local knowledge. It addresses check pilot and mentor pilot requirements and contains a code of conduct for marine pilots. NSW Marine Pilotage Code - Volume TwoThis volume addresses the health requirements for marine pilots and incorporates the Standard for Health Assessment of Marine Pilots (NSW). The Standard was initially introduced in late 2009, as an interim measure, until development of pilotage legislation amendments were completed. It is a non-prescriptive, performance-based standard which adopts a risk management approach. It reflects contemporary medical knowledge and current understanding of the impact of certain health conditions on safe working performance. Contemporary anti-discrimination and privacy principles now legislated in all Australian States and Territories have also been taken into account. Assessment of marine pilot health against this Standard will be carried out by medical practitioners who have been engaged and trained by NSW Maritime. The NSW Marine Pilotage Code, the Health Standard, associated forms and the details of medical practitioners who are authorised to carry out health assessments of marine pilots in NSW can be accessed below. In accordance with the Government’s strategy to reduce the regulatory burden on business, a Regulatory Impact Statement has been prepared to demonstrate that the Regulation is required, responsible and responsive.

NSW Maritime has reviewed the NSW marine pilotage legislation. This work was carried out in conjunction with the NSW port corporations and marine pilots. The review found the legislation required consolidation and some amendment, and the then current Training Code for Marine Pilots and Exempt Masters 2003 needed to be replaced with more contemporary requirements.
